Bethesda Legal Team Target Fallout 3 Fan

It appears the Fallout fan who owns Fallout3-Posters has been in a on going dispute over fan made art for the game that Bethesda consider to be a breach of their intellectual copyright and want it removed according to Gamespot UK. They are also demanding the sites domain name be handed over to them too which strikes me as wrong but more on Bethesdas fancy ideas on site ownership later.

Without knowing more details, its hard to comment but if this was just a fan art site running on fallout-posters.com hosting fan made art, then it strikes me that Bethesda should not be too concerned at all. So this all sounds very odd to me.

Bethesda have no rights what so ever to be targeting a user like that on his own website over fan material or demand he hand over a domain he owns. There is a modding scene which they support which is basically the same thing and does this all the time. 

UNLESS the guy was selling Fallout 3 posters in which case I am not surprised Bethesda went after him. Beth are aggressive in this area in going after IP breaches but they do bend their own rules for some sites like Nexus.

 

Personally I suspect there is more to this than we are hearing, Bethesda will not say anything whilst legal process is on going. We know that about them already so we can only speculate on whats going on.

In the past I have experienced that side of Bethesda my self, Bethesda have some strange ideas of just how far their IP rights allows them to go with fans. For example they once tried telling me what I could do on my site and I had to tell them what I did on my site was my business not theirs because they seemed to think that just because I modded Oblivion at the time, that give them rights over my website.

Which btw was a site called Mechstorm and the name never once gave away to Bethesda that it was primarily a Mechwarrior site at the time.

My take: This is either the result of a) a new guy in the legal department wanting to make a splash or b) something more going on, possibly involving posters like you said. It's also possible that there was some minor legal violation going on that one side is blowing out of proportion.
